Terms of Service

By creating an account or using Trellis in any way, you confirm that you are at least 13 years old and that you accept these Terms. If you are using the app on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You may use many features of Trellis without creating an account. When you do create an account, you agree to:

• Provide accurate and complete information during registration
• Keep your login credentials secure. You are responsible for all activity that occurs under your account. Trellis is not liable for any loss resulting from unauthorized use of your account.
• Notify us immediately at trellisplants@gmail.com if you believe your account has been compromised
• Not share your account with others or create accounts on behalf of others without their consent

We reserve the right to suspend or delete accounts that violate these Terms, at our sole discretion.

What we own: Trellis, the “Trellis” name and logo, the app's source code, UI design, planting schedule algorithms, succession planting logic, and all other original content created by us are our exclusive property and are protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, or create derivative works from any part of the service without our prior written consent.

What you own: You retain full ownership of all data, photos, notes, garden records, and other content you upload or create within the app (“Your Content”). By uploading content, you grant us a limited, non-exclusive, royalty-free license to store and process Your Content solely to provide the service to you. We will never sell, license, or use Your Content for advertising without your explicit consent.

AI-generated output: Diagnostic results, planting recommendations, and other AI-generated content produced in response to your inputs are provided for your personal use. We do not claim ownership over these outputs.

You agree not to use Trellis to:

• Scrape or harvest data — systematically extract planting schedules, frost date data, location-specific crop recommendations, or any other content from the app by automated means, without our prior written permission
• Reverse-engineer, decompile, or attempt to extract the source code or underlying algorithms
• Resell or commercially redistribute the app's content or data without authorization
• Interfere with or disrupt the security or performance of the service
• Upload content that is illegal, harmful, or infringes on the rights of others
• Attempt to gain unauthorized access to other users' accounts or data

We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine that you have:

• Violated these Terms, including by scraping or abusing location-specific data
• Engaged in behavior that harms other users or the integrity of the service
• Provided false information at registration

You may delete your own account at any time by contacting us at trellisplants@gmail.com. Upon termination, your right to use the service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimer, and limitation of liability provisions) will survive.

Trellis is currently offered free of charge. If we introduce a paid plan or freemium model in the future, the following terms will apply:

• Billing: Paid plans will be billed on a recurring basis (monthly or annually) via our payment processor. All prices will be displayed clearly before purchase.
• Cancellation: You may cancel a paid subscription at any time. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until then.
• Refunds: We will evaluate refund requests on a case-by-case basis. We do not guarantee refunds for partial billing periods.
• Price changes: We will provide at least 30 days' notice of any price change to existing subscribers, via email or in-app notification.

We will update this section with complete billing details before any paid tier launches, and will notify existing users in advance.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PLANTING RECOMMENDATIONS WILL RESULT IN A SUCCESSFUL HARVEST.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRELLIS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING CROP FAILURE, FINANCIAL LOSS, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or a court of competent jurisdiction in accordance with applicable law.

We may update these Terms from time to time. We will update the “Last updated” date at the top of this page. For material changes, we will notify signed-in users via email or an in-app notice at least 14 days before the changes take effect. Continued use of the service after changes take effect constitutes your acceptance of the updated Terms.
